We sent a certified letter on May 28,2008 to Mayor Maclean,all council members, code officer and Jeff kobrock in an effort to resolve the animosity problem, every single member of city of Gardiner government has refused to reply. Read the letter yourself and decide if the city has a animosity problem. The city of Gardiner has spent thousnds upon thousands of dollars of taxpayer money on a problem that is easily resolved. The lawsuit against the city has lasted 3 years, there are over 14 pages of docket records and thousands of pages of documents. The city refuses to clean up the animosity problem by firing Kobrock, the ringleader of the problem. How are any of the city's actions justified in the eyes of the taxpayer? We do not understand how the city council can continue to support Kobrock and the waste of taxpayer money that could be used to enhance the city itself, fix the broken playground, fix broken sidewalks or start a fund to help people to heat their homes this winter.The city forces us to sue them again, all we want to do is rebuild our home.

Dear Sirs,
This letter is about permit renewals this is why I am addressing this letter to the city directly, however there is much more to this so I am addressing these issues to all city council members, it is your responsibility as council members and Mayor to conduct the city of Gardiner in a lawful and legal manner, I am afraid to come to the city to come before you personally so I am addressing you by this letter. I am concerned that the city of Gardiner under the direction of certain individuals has formulated a hate, retaliation, animosity mentality that will stop at nothing. This is not just my saying, a court Judge said this about the City of Gardiner just before he issued an injunction against the city and extended it for a total of about 3 months.
Doesn’t that bother you as city Councilors and Mayor? The judge also said the city was stupid and there was animosity. As you drive past my home on 173 Highland Ave do you ever wonder why this man has a half a house torn off and has not yet finished this project? I think that question deserves an explanation.
First of all that injunction was a direct result of the city burying my tools and threatening me. The hole that the city said was a safety issue was there for 9 MONTHS because there used to be a house there and the hole was actually a cellar hole since the house was originally built. The house was demolished because it was in danger of collapse. That hole was protected by a barrier, old foundation walls that were sticking up and then by rock and dirt 3 feet high, it was not possible to drive into the hole, it was also taped off with safety tape. This is why Chichowski never approached us during 9 months of exposure; otherwise any normal code enforcement officer would address the problem immediately, why would you risk a safety issue for 9 months? Does this make sense to you? You will be shocked to learn that the grandfather clause of that permit expired on June 12, 2007 that allows us to replace that part of the old house with new foundation footings for a deck.
This is why Chichowski and the city police, city officials, city dump truck, city backhoe came to my home on JUNE 5, 2007 just 7 DAYS before the expiration of the grandfather clause. You will notice that Cichowski starts yelling at us “YOUR PERMITS ARE EXPIRED” (he was on video) he is referring to the GRANDFATHER CLAUSE of the permit because the permit doesn’t expire until June 12, 2008. At that time we were about to pour the footings that were about to expire on June 12, 2007 just seven days prior to the expiration date. The City buried our project in an attempt to stop our lawful permitted construction before we had a chance to pour the footings.
These are the same permits that we had to fight for and sue the city over. The city had no intention of honoring their permits regardless of who issued them. The city did not anticipate that we were capable of re-digging the hole, removing the mud caused by the city, refilling the base with rock and gravel and tamping it down with a tamper and pouring concrete and rebar before the expiration date of June 12, 2007. The city was wrong, we did it in 5 days ourselves, the city came back with a vengeance on June 11, 2007 and buried our tools and in addition this time buried our new foundation footings. Do you see what I mean by animosity? Kobrock sent 4 police cars to my home to prevent me from working on a project that I had permits for, why would you do that, why would you tie up all this police power to prevent a man from working on his house? The answer is simple, if you can’t deny him his permits then arrest him for something and make him look like a criminal so that when he does go to court against the city he will have no creditability.
Does that make sense to you? This is exactly why he sent 4
police cars to my house, to arrest me, the Judge said so. Sargent Guilnette said Kobrock was running the whole show. (that was on video) of course Sargent is no longer working in Gardiner and now works for Skowhegan police, the interesting fact is that his retirement came within 30 days of the incident.
Kobrock uses the City of Gardiner including the police to retaliate against people with a vengeance. He sent the police after me at city hall when I was trying to get a plumbing permit, a permit that is mandated by state law (that was recorded also, if you want to hear it yourself then go to www.gardinermaineproblems.com)
The things I have described to you is just the tip of the iceberg.
This whole problem with Kobrock started when I complained about Kobrock stealing my money to repair my home, this happened to be $25,000.00 that I need to fix my foundation. After I filed this complaint with Orman Withcomb Kobrock got real mad, Orman Withcomb couldn’t find any proof against Kobrock, so he let him go. It took me 2 years to find those documents, it proves without question the city committed fraud by making rule changes after the fact, if you want to see those documents let me know.
If what I am telling you above is true, then these acts alone warrant you to take a good look at what Kobrock is doing to the city. Kobrock is using the City as his own retaliation platform. How do you justify denying a man a permit to fix his collapsing home? Did you see my foundation? In some places there never was a foundation to begin with. How do you justify fraud? Look at the documents. (Ask me to send you a set; it’s your responsibility to hire people that are honest)
I am trying to help you understand what is going on in your own city, you have a choice, you can take up empty chairs and just sit there like you have no brain and let someone else do all the talking or you can take an active part and try to make a difference in the lives of the people that live here, does this make sense to you?
I am asking you not to bury your head in the sand. Have you seen the city policy that Kobrock made against me the Kobrock memoranda dated June 10, 2004?
Who in their right mind would make such a policy? That policy and the Issuance 151 ordinance will never hold up in court, you are asking for another lawsuit if you do not remove that policy and ordinance, it may not be from me but it will be from somebody.
The point I am trying to make is, it is not necessary to make stupid decisions’ in Gardiner is it?
That policy and 151 ordinance are preempted by state statute, you cannot make city policy and ordinance that are preempted by the state.
If you look at the city records you will discover that the policy and ordinance was conceived in secret government meetings.
I have only touched on a few of the items that I think was important for you to know, how else are you going to run a city unless you get feedback?
If I do not receive permit renewals within 14 days I will have to stop construction.
I expect the ongoing 3 year lawsuit against the city to be settled soon. This lawsuit has taken up a lot of my time in legal research, there are thousands of pages of documents involved unless you are a lawyer, you have no idea of how intense it is and the lawyers have the advantage of law school, I don’t, it is like a whole new language.
I hope that the money the city stole from me and the over taxation money stolen under the threat of eviction as described in a letter to Evert Fowle (go to www.gardinermaineproblems.com to see a copy) is returned by the court so that I can use it for the purpose it was intended for, however regardless of the outcome of the lawsuit my construction project must continue otherwise my family and I will have no home and that was the whole purpose of the permits, so we could fix our home so we could have a place to live, the permits were denied to us for 8 months, our bathroom permits were denied for several weeks, our rehabilitation money was stolen from us, the city buried my tools and threatened to arrest me for working on my own home that they gave me a permit for (the Judge said so), the city made policies and ordinances in retaliation against one man and the previous Mayor said
the city has the right to deny all permits including hunting, fishing, all registration of vehicles except vehicles to go to work (it was recorded)
You have a responsibility to the taxpayers of Gardiner, I am one of them, I have been for 38 years. Please eliminate retaliation, malice, animosity and corruption from the City of Gardiner. I will be expecting a permit renewal within the 14 days, I am not looking forward to another lawsuit, please do the right thing this time, thanks.

The Church Connection-- fact is city manager Kobrock, city mayor MaClean, previous mayor Brian Rines and several other individules connected to city government all go to the same church. It is difficult to remove corrupt city government when they are all connected to the same church. This is kind of like a secret society that operates under the radar of public view.
